Buying Land In Kenya, Here Is Procedure

1.Ask to see the Title deed or copy of tittle deed. then do a search at the ministry of lands to confirm who the real owners are or if the tittle has any caveat on it. the search will cost kshs.520.

2. Do a search with the local authorities to check of any unpaid land rates. If any, agree with the seller on who will settle the debt. Nb/ land can't be transferred if there are any unpaid land rates.

3. Go to the ministry of lands and buy two maps. One showing the exact measurements of the piece you're buying (called mutation) and the other showing the neighbouring lands. Each costs ksh 350.

4. With your two maps and a surveyor ( you can even do it yourself) visit the land you're buying and verify the details in the map. Check all the beacons.

5. Sit down with your seller and bargain the price. Write down the agreement. The agreement can be done before a lawyer or you may decide to do it yourself.( It is not a must to be written by a lawyer). According to LSK if the value of the land is below 1M, you pay the lawyer 3k, if above 1M you pay the lawyer 8k (Sometimes the lawyer's fee is a negotiated agreement depending with the value of the property. The lawyer's fee can also be shared equally between the seller and the buyer). If married, it's advisable that your SPOUSE MUST BE PRESENT. If married any property acquired during this period is considered matrimonial property.

6. Pay some amount or as per the agreement . Don't pay everything, even if you have lots of money. Don't pay CASH, do a bank transfer to the seller or pay direct to his or her account. This shows evidence of who paid and the payee.

7.Book a meeting with the lands control board(LCB). They meet once a month. It will cost you ksh 1000. But there is a special LCB meeting which you can book at 10k. LCB will issue consent for the land to be sold.

8. Pay the remaining balance after getting consent from LCB.

9. With consent from LCB, clearance from county land rates, your two maps, the agreement, KRA pin, 2 passports and copy of the tittle deed, go to the ministry of lands and change ownership. It costs 5k.

10. At this stage you nolonger need the seller, tell him/ her to enjoy the benefits. Now go and pay stamp duty i.e according to the value of the land.

11. Now the land is yours.before celebrating, go to the ministry of lands and do a search to confirm if it really reads your name.

12. If on your name, carry on with your planned development.
